Alaca\u011f\u0131 m\u00fclke karar veren al\u0131c\u0131, sat\u0131n alma i\u015flemleri i\u00e7in gerekli t\u00fcm prosed\u00fcrleri yerine getirmelidir.<\/p>\n\n\n\n<p>Sat\u0131n alma s\u00fcreci 3-6 ay gibi bir s\u00fcre\u00e7te ger\u00e7ekle\u015fir, fakat i\u015flemlerin onaylanmas\u0131 a\u015famas\u0131nda ge\u00e7en s\u00fcre zarf\u0131nda, sat\u0131n al\u0131nan m\u00fclkiyeti kiralamak ve satmak m\u00fcmk\u00fcnd\u00fcr.<\/p>\n\n\n\n<p>KKTC vatanda\u015f\u0131 olmayanlar, Kuzey K\u0131br\u0131s&#8217;ta ev yat\u0131r\u0131m\u0131 yapmak i\u00e7in KKTC Devleti\u2019nden &#8220;Emlak Al\u0131m \u0130zni&#8221; \u00e7\u0131karmal\u0131d\u0131r. &#8220;Emlak Al\u0131m \u0130zni&#8221; olmadan tapu devir i\u015flemleri yap\u0131lamaz. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-satin-alinacak-emlak-secildikten-ve-fiyat-konusunda-anlasildiktan-sonra-bir-avukat-araciligi-ile-alici-ve-satici-arasinda\"><span class=\"ez-toc-section\" id=\"satin-alinacak-emlak-secildikten-ve-fiyat-konusunda-anlasildiktan-sonra-bir-avukat-araciligi-ile-alici-ve-satici-arasinda\"><\/span>Sat\u0131n al\u0131nacak emlak se\u00e7ildikten ve fiyat konusunda anla\u015f\u0131ld\u0131ktan sonra, bir avukat arac\u0131l\u0131\u011f\u0131 ile al\u0131c\u0131 ve sat\u0131c\u0131 aras\u0131nda; <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Fiyat, zaman, \u00f6deme ve teslimat ko\u015fullar\u0131, emlak detaylar\u0131 gibi konular\u0131 bar\u0131nd\u0131ran bir sat\u0131\u015f s\u00f6zle\u015fmesi imzalanackt\u0131r. <\/p>\n\n\n\n<p>\u0130ki taraf\u0131n da imzalamas\u0131 halinde sat\u0131\u015f ger\u00e7ekle\u015fir.<\/p>\n\n\n\n<p>Vergi Dairesi\u2019ne onaylatt\u0131r\u0131lan sat\u0131\u015f s\u00f6zle\u015fmesi, \u015fu anki yasaya g\u00f6re kontrat fiyat\u0131 \u00fczerinden %0.5 olan pul \u00fccreti \u00f6denerek yine 21 g\u00fcn i\u00e7inde Tapu Dairesi\u2019ne kaydettirilmelidir.<\/p>\n\n\n\n<p>K\u0131br\u0131s&#8217;ta ev yat\u0131r\u0131m\u0131 B\u00f6ylece al\u0131c\u0131n\u0131n m\u00fclkiyet hakk\u0131, hukuki a\u00e7\u0131dan yasall\u0131k kazan\u0131r.<\/p>\n\n\n\n<p>Sat\u0131lan gayrimenkul\u00fcn \u00fc\u00e7\u00fcnc\u00fc \u015fah\u0131slar\u0131n tasarrufuna veya m\u00fclkiyetine ge\u00e7meyece\u011fine dair bir taahh\u00fctname de sat\u0131c\u0131 taraf\u0131ndan Tapu Dairesi\u2019ne kaydettirilmelidir.<\/p>\n\n\n\n<p>\u00d6deme ger\u00e7ekle\u015ftikten ve al\u0131m izni \u00e7\u0131kt\u0131ktan sonra emlak tapusu al\u0131c\u0131n\u0131n ad\u0131na \u00e7evrilecektir. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-alici-ve-saticinin-satis-sozlesmesindeki-yukumluluklerini-yerine-getirmeleri-sonrasinda-satici\"><span class=\"ez-toc-section\" id=\"alici-ve-saticinin-satis-sozlesmesindeki-yukumluluklerini-yerine-getirmeleri-sonrasinda-satici\"><\/span>Al\u0131c\u0131 ve sat\u0131c\u0131n\u0131n sat\u0131\u015f s\u00f6zle\u015fmesindeki y\u00fck\u00fcml\u00fcl\u00fcklerini yerine getirmeleri sonras\u0131nda sat\u0131c\u0131; <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Konutun m\u00fclkiyetini, konutun bulundu\u011fu Kaza Tapu Dairesi\u2019nde al\u0131c\u0131ya devreder.<\/p>\n\n\n\n<p>Al\u0131c\u0131, sat\u0131n ald\u0131\u011f\u0131 gayrimenkul\u00fcn &#8220;Tapu Devir Harc\u0131n\u0131&#8221; \u00f6demekle y\u00fck\u00fcml\u00fcd\u00fcr. Tapu Devir Harc\u0131, Tapu devri yap\u0131laca\u011f\u0131 zaman Kuzey K\u0131br\u0131s Tapu Dairesi&#8217;ne \u00f6denmektedir. <\/p>\n\n\n\n<p><strong>Al\u0131c\u0131n\u0131n ilk gayrimenkul\u00fc ise;<\/strong><\/p>\n\n\n\n<p> indirimli olarak sat\u0131n al\u0131nan gayrimenkul\u00fcn sat\u0131\u015f fiyat\u0131n\u0131n %3&#8217;\u00fc kadar olan devir harc\u0131 \u00f6denmektedir.<\/p>\n\n\n\n<p>Mali a\u00e7\u0131dan yasal h\u00e2le gelen ta\u015f\u0131nmaz mal\u0131n, yabanc\u0131 ad\u0131na kayd\u0131 i\u00e7in KKTC\u2019de Bakanlar Kurulu\u2019na ba\u015fvuru yap\u0131lmas\u0131 ve Bakanlar Kurulu\u2019ndan sat\u0131n alma iznini almas\u0131 gereklidir.<\/p>\n\n\n\n<p>Yabanc\u0131 uyruklu ki\u015filer, Kuzey K\u0131br\u0131s\u2019ta kay\u0131tl\u0131 yerel \u015firketlerinin olmamas\u0131 durumunda, Kuzey K\u0131br\u0131s&#8217;tan ki\u015fi ba\u015f\u0131na 5 d\u00f6n\u00fcme kadar araziye sahip 1 ev veya en fazla 1 d\u00f6n\u00fcm b\u00fcy\u00fckl\u00fc\u011f\u00fcnde arazi alabilirler. <\/p>\n\n\n\n<p>Evli \u00e7iftler 1 ki\u015fi olarak kabul edilir, ancak soyadlar\u0131 farkl\u0131 ise 2 ayr\u0131 gayrimenkul alma imk\u00e2nlar\u0131 olacakt\u0131r. <\/p>\n\n\n\n<p>Birden fazla ta\u015f\u0131nmaz mal veya 1 d\u00f6n\u00fcmden daha b\u00fcy\u00fck mal al\u0131nmak istenilirse, KKTC\u2019de \u015firket kurmak gerekmektedir. <\/p>\n\n\n\n<p>S\u00f6z konusu ta\u015f\u0131nmaz mal \u00fczerinde bulunan in\u015faat ve\/veya ev i\u00e7in in\u015faat izin ruhsat\u0131 al\u0131nmal\u0131, sat\u0131n al\u0131nacak ta\u015f\u0131nmaz mal \u00fczerinde herhangi bir ipotek ve\/veya engel olmamal\u0131, sat\u0131c\u0131 ger\u00e7ek mal sahibi olmal\u0131d\u0131r. <\/p>\n\n\n\n<p>\u0130zin i\u015flemleri olumlu sonu\u00e7land\u0131ktan sonra, sat\u0131n al\u0131nan m\u00fclkiyetin m2\u2019si i\u00e7in Vergi Dairesi\u2019ne senelik belirlenen \u00fccretlerde har\u00e7 yat\u0131rmak gerekmektedir. Bu tutar\u0131n, isme kay\u0131tl\u0131 her m\u00fclkiyet i\u00e7in senelik olarak \u00f6denmesi gerekmektedir.
