Lost Title Deed in the TRNC? Duplicate Application
Short answer: If a title deed (koçan) is lost in Northern Cyprus (TRNC), you do not lose your ownership; ownership is based on the record at the Land Registry and Cadastre Department. The answer to what to do if a title deed is lost is to apply to the district land registry office to which the property is attached and request a duplicate title deed: the Land Registry and Cadastre Department Law assigns the Department the duty to prepare a duplicate for the property owner upon request for a lost title deed. Before applying, you should verify that the record is up to date with a search certificate and make sure the title deed is genuinely lost, for example that it is not held by a bank or a lawyer.
This article was prepared for homeowners in the TRNC who cannot find the title deed for their home, lost it during a move, or had their title deed stolen, as well as families who cannot locate the title deed in inheritance matters. We explained what a title deed is and its types in our article on TRNC title deed types; here, we focus on the route to follow when the title deed is not in your possession.
Does a lost title deed affect your ownership?
No. A title deed is a document showing ownership; ownership itself is registered in the ledger at the district land registry office. Even if your title deed is lost, you continue to appear as the owner in the record. For this reason, losing a title deed is not a cause for panic, but an administrative matter requiring a proper application.
The risk of misuse is also limited, because in the TRNC a title deed transfer is not carried out by handing over the title deed, but by the owner or their attorney signing the transfer declaration before the land registry officer with proof of identity. The real risk is the use of a forged or very broad power of attorney together with the title deed. Therefore, when a title deed is lost, you should not only request a duplicate but also check whether any unexpected transaction has been entered in the record. We explained how to check the land registry record in our article on TRNC title deed searches.
What to do if a title deed is lost: step by step
An application for a duplicate title deed is made to the district land registry office where the property is registered. The Land Registry and Cadastre Department has six district branch offices: Lefkoşa, Gazimağusa, Girne, İskele, Güzelyurt, and Lefke. The general process is as follows:
- Ask where the title deed might be: If you purchased with a loan, the title deed may be at the bank; the Immovable Property (Transfer and Mortgage) Law gives the mortgage creditor the right to request and keep the title deed during the mortgage period. Also check whether it may have remained in your lawyer’s file, with the after-sales service team, or with your attorney.
- If it was stolen, put it on record: If the title deed was stolen during a theft incident, report the matter to the police and keep the notification document; this document may be useful in your application.
- Verify the record: Obtain a search certificate from the district land registry office or through your lawyer. Confirm that you appear as the owner and that no mortgage, attachment, or new annotation has been entered.
- Apply for a duplicate: Apply to the district land registry office with your ID or passport; a petition or declaration stating that the title deed has been lost may be requested.
- Pay the fee: A fee is expected to be charged for issuing the duplicate; ask the office for the amount at the time of application.
- Check the new title deed: On the duplicate you receive, compare your name, parcel and independent unit number, area, and share ratio with your previous documents.
- If the old title deed is found: If you find the old title deed after a duplicate has been issued, ask the office what you should do; it is good practice not to have two documents circulating at the same time.
The Land Registry and Cadastre Department announced that, due to the transition to the new automation system in July 2025, transfers, mortgages, search certificates, and file transactions would temporarily be carried out only at the district land registry office to which the property is attached. Before applying, confirm with the relevant office whether this practice is still in effect and which documents are required for a duplicate title deed.
Where should you apply in different situations?
The reason why the title deed is not in your possession changes the route you should follow. The table below summarizes the most common situations.
| Situation | First step | Place of application |
|---|---|---|
| Title deed is lost, whereabouts unknown | Check with the bank, lawyer, and attorney | District land registry office (duplicate) |
| Title deed was stolen | Police report, search certificate | District land registry office (duplicate) |
| Damaged due to fire, flooding, or similar reasons | Keep and photograph the damaged document | District land registry office |
| Home bought with a loan, title deed at the bank | Written confirmation from the bank | Bank; returned when the mortgage is released after the loan is closed |
| Owner has passed away, title deed cannot be found | Probate or letters of administration from the court | District land registry office through the appointed person |
| Owner is abroad | Power of attorney with clear scope | District land registry office through the attorney |
Title deeds for homes bought with a loan
You may never have seen the title deed for a home you purchased using a loan. Under the Immovable Property (Transfer and Mortgage) Law, when the debt is paid, it is the mortgage creditor’s duty to ensure that the mortgage is released; the land registry director deletes the mortgage entry in the register and on the title deed and returns the title deed to the debtor. In this case, what needs to be done is not to request a duplicate, but to follow up on the release of the mortgage and the return of the title deed when the loan is closed.
Title deed not found in an inheritance
When the owner passes away, the process does not stop even if the heirs cannot find the title deed. For immovable property in the TRNC, probate or letters of administration must first be obtained from the District Court; the transfer of title is then carried out at the district land registry office with this decision. Inform the lawyer handling the file from the outset that the title deed is missing. The full process is covered in our article on title deed transfer by inheritance in the TRNC.
If no title deed was ever issued for a project property
In some project-based homes, the buyer holds not a title deed but a sales contract registered at the land registry. The reason is usually that the building has not yet been converted to condominium ownership, or that the foreign buyer’s permit and transfer have not been completed. In this situation, there is no lost title deed; the documents that must be protected are the original contract and the land registry registration certificate. If you think your contract has been lost, request a copy from your lawyer and the developer, and have it confirmed that the registration remains at the district land registry office. We explained when the title deed is issued in our article on when title deeds are issued for projects in the TRNC.
How do you apply if you are abroad?
If you live in Turkey or another country, you may not have to come to the TRNC to apply for a duplicate title deed; the transaction can be handled through your lawyer or a trusted person with a power of attorney whose scope is clearly written. The power of attorney should include the property’s parcel and independent unit details, as well as authority to obtain a search certificate, apply for a duplicate title deed, pay the fee, and collect the title deed.
The key point here is the scope of the power of attorney. The power of attorney you give for a duplicate title deed should not include authority to sell or mortgage. A power of attorney with general wording may both be rejected by the office and grant broader authority than necessary. We explained the details of preparing a power of attorney in our article on buying a home in Cyprus by power of attorney.
Precautions to avoid losing your title deed
Although it is possible to obtain a duplicate title deed, every application means time and expense. A few simple habits both prevent loss and speed up your work if a loss occurs.
- Keep the original title deed in a fireproof safe or a bank safety deposit box.
- Keep a high-resolution color copy in the cloud and in your lawyer’s file; also note the parcel and independent unit numbers separately.
- Complete the Web Tapu registration announced by the Land Registry and Cadastre Department on 1 October 2026; the Department recommends this registration to benefit from the digital services of the new TAKBİS system.
- Do not hand over the original title deed to anyone unless the original is required; a copy is sufficient for a real estate agent, tradesperson, or tenant.
- If you are not on the island for long periods, have your record checked once a year with a search certificate.
- Terminate the powers of attorney you have given by revoking them once your business is complete.
- During periods such as moving, renovation, or tenant changes, move the documents to a place you trust instead of leaving them at home; a significant portion of losses occurs during these transition periods.
- Tell at least one family member where the title deed and other documents are kept; failure to find the document in inheritance matters unnecessarily prolongs the process.
If you are planning to sell, make the duplicate application before finding a buyer; it is standard practice for the seller to be asked for the current title deed on the transfer day, and a missing document may lead to the appointment being postponed. Frequently asked questions
My title deed is lost; could I lose my home?
No. Ownership is based on the record at the district land registry office; the title deed is the document showing that record. Even if the title deed is lost, you continue to appear as the owner in the record. Still, obtain a search certificate to make sure there is no unexpected transaction in the record and apply to the district land registry office to which the property is attached for a duplicate title deed.
Where do I apply for a lost title deed?
The application is made to the district land registry office where the property is registered: Lefkoşa, Gazimağusa, Girne, İskele, Güzelyurt, or Lefke. The Land Registry and Cadastre Department Law assigns the Department the duty to prepare a duplicate for the property owner upon request for a lost title deed. Confirm the required documents and fee with the relevant office before applying.
Can my home be sold with a stolen title deed?
A sale cannot be made with the title deed alone; in the TRNC, title deed transfer takes place when the owner or their valid attorney signs the transfer declaration before the land registry officer with proof of identity. The real risk is a forged or broad power of attorney. Report the theft to the police, check your record with a search certificate, and revoke unnecessary powers of attorney.
Why don’t I have the title deed for my mortgaged home?
The Immovable Property (Transfer and Mortgage) Law gives the mortgage creditor the right to request and keep the title deed during the mortgage period; therefore, the title deed may be at the bank. When the loan is closed, it is the creditor’s duty to ensure that the mortgage is released, and the land registry director deletes the mortgage record and returns the title deed to the debtor. In this case, you need to follow up on the return, not request a duplicate.
Can I obtain a duplicate title deed while abroad?
Yes, the transaction can be handled through your lawyer with a power of attorney whose scope is clearly written. The power of attorney should include parcel and independent unit details, and authority to obtain a search certificate, make the duplicate application, pay the fee, and collect the title deed. Prefer a transaction-specific power of attorney that does not include authority to sell or mortgage.
