Renting While Waiting for TRNC Permission
Short answer: While waiting for Council of Ministers permission in Northern Cyprus (TRNC), it is possible to live in a delivered home and rent it out if your sales contract allows this. The title deed remains in the seller’s name until permission is granted; your right of use arises from the contract. Under regulation 89/2026, because electricity and water connections cannot be made before taxes and fees are paid, you need to plan your timeline accordingly.
This article is prepared for buyers who have signed their contract, received their keys or are about to receive them, but whose purchase permission has not yet been published in the Official Gazette. We explain what is possible in terms of renting out the home, living in the home and, if necessary, selling it while waiting for permission, which documents you should have, and the most common mistakes. For the full permission process, you can see our guide to TRNC Council of Ministers permission.
Can I live in the home while waiting for permission?
Yes; if the property has been delivered and the sales contract grants the buyer a right of use, you can live in the home while waiting for permission. During this period, your legal status is not “owner” but “buyer holding a registered contract.” The title deed remains in the name of the contractor or seller, but because your contract is registered with the Land Registry, the seller cannot sell the same home to someone else.
In practice, this has three consequences. First, the limits of your right of use are defined by the contract; there should be a clear clause such as “the buyer may use the property from delivery.” Second, the contract should state who is responsible for expenses such as maintenance fees, insurance and minor repairs from the moment the delivery report is signed. Third, in a residence permit application, your registered contract and payment receipts are used instead of a property ownership document; according to the practice of the Immigration Office, at least one third of the price must have been paid.
For a property that has not yet been delivered and is still under construction, “living in it while waiting for permission” is not applicable. In this case, the permission process usually proceeds in parallel with construction, and for many buyers it may even be possible for permission to be granted before delivery.
Electricity and water: the 89/2026 requirement
According to decree no. 89/2026, permanent electricity and water connections cannot be made to an immovable property before all taxes and fees have been paid. According to news summaries, this prohibition also covers temporary connections; only site electricity and temporary water during construction are exempt. This information is as of October 2026; confirm the practice of the Land Registry and Kıb-Tek with your lawyer.
This rule disrupts the plan of “I have received the keys; I will pay the fees when permission is granted.” Transfer fees are normally paid within 75 business days after the publication of the permission; however, it is not possible to live in the home or place a tenant there without electricity and water. Therefore, buyers who want to move in while waiting for permission need to clarify before delivery which tax and fee items are considered sufficient for connection.
The cost of the electricity connection itself should also not be overlooked: for a new property, a budget of approximately 1.200–2.500 £ is being discussed for the meter and connection as of October 2026. This item is often not included in the contractor’s price; check your contract to see who will pay it.
Renting out the home while waiting for permission
Renting out a home while waiting for permission is possible in the TRNC, but the authority to rent must be clearly written in the sales contract or separate written approval must be obtained from the seller. Since the title deed is not in your name, your capacity in the contract you sign with the tenant should be stated as “buyer holding a registered contract.”
Long-term rental
Long-term rental is the least problematic option during the permission period. A written contract is signed with the tenant, a deposit is taken, and it is determined who is responsible for maintenance fees and bills. The term of the rental contract should be structured in a way that protects both your rights and the seller’s rights against the possibility of permission being refused; for example, a one-year contract does not leave the tenant’s situation uncertain in the event of refusal.
Short-term (daily) rental
There are additional questions in short-term rental. Does the site management plan allow daily rentals, and is a notification or licence required for hotel-like operation? A regulation for registering short-term rental homes in North Cyprus has been on the agenda since 2024; confirm the current status with the Ministry of Tourism and Environment or your management company.
Tax
Even if the property is not in your name, rental income is your income and is taxable. According to the 2020 Council of Ministers decision, withholding tax of %13 applies to rent in foreign currency and %8 to rent in TL; the current validity of the rates should be confirmed. For details, consult the TRNC Ministry of Finance page and your financial adviser.
Example calculation: rental income during the waiting period
The permission period is not officially defined; sources indicate periods ranging from a few months to one year, and longer in some files. For planning purposes, let us assume a 12-month waiting period and compare two scenarios for a delivered 1+1 apartment in İskele Long Beach. The figures are approximate as of October 2026.
| Item | Long-term rent | Short-term rent |
|---|---|---|
| Assumption | Monthly 650 £, occupied for 10 months | Nightly 84 €, %45 occupancy |
| Annual gross income | 6.500 £ | Approximately 13.800 € (164 nights) |
| Rental withholding tax (%13, foreign currency) | 845 £ | Must be confirmed according to income type |
| Additional expenses | Maintenance fee, minor repairs | Platform commission, cleaning, bills, management |
| Additional risk | Low | Site rules, notification obligation, seasonal fluctuations |
The gross figure for short-term rental looks attractive, but it has two disadvantages for a buyer in the permission period. Expenses are high and income depends on the season; moreover, if permission is refused, cancelling short-term reservations is more complicated than reaching an agreement with a long-term tenant. We recommend using a cautious occupancy assumption of %40–50. For details of yield calculations, you can see our Cyprus rental yield calculation guide.
Can you sell the home before permission is granted?
You cannot sell the home through the Land Registry before permission is granted, because the title deed is not in your name; what you can do is assign your rights under the sales contract to a new buyer. This assignment is usually subject to the written approval of the seller or contractor, and your contract should be checked to see whether there is a prohibition on assignment or an assignment fee.
If the new buyer in an assignment is a foreigner, the process starts again for that buyer: their own contract is registered at the Land Registry within one month, their own purchase permission application is made, and their own security screening is conducted. Whether your pending application will be withdrawn and whether items such as stamp duty will arise again should be clarified between the lawyers. For the registration period for the new contract and what happens if it is missed, see our article on registering the contract at the Land Registry and the 1-month rule.
If permission is refused: tenants and expenses
If permission is refused, the basis for your right to use and rent out the home disappears; the tenant’s situation and the refund of the amount paid are resolved according to what is written in the contracts. Therefore, every rental contract made while waiting for permission should provide for what will happen if the buyer’s right ends.
Another point to pay attention to is the expenses incurred during this period. Movable items such as furniture, air conditioners and curtains belong to you; however, for changes attached to the structure, such as a kitchen renovation or enclosed balcony, what will happen in the refund calculation in the event of refusal may remain unclear. Waiting period checklist
Completing the following steps in order in order to live in the home or rent it out while waiting for permission prevents most disputes that may arise later. This is also largely the list that the Akol Global after-sales team reviews with buyers during the delivery period.
- Registration document: File the certified copy showing that the contract was registered with the Land Registry within one month, and the Ministry of Interior application receipt.
- Tax and fee receipts: Keep the receipts for stamp duty and other payments required for connection; they are requested in electricity and water applications.
- Delivery report: Take delivery of the property in writing together with the snagging list; this is the date on which maintenance fee and insurance responsibility begins.
- Rental approval: If there is no clear clause in the contract, obtain written approval from the seller.
- Rental contract: Sign a written contract with the tenant that also regulates the case of permission being refused.
- Tax registration: Set up the system for declaring rental income or managing withholding tax with your financial adviser.
- Calendar: When permission is published, enter the 75-business-day fee period and the one-year transfer period into your calendar.
If you cannot handle tenant finding, contracts and collection remotely, the rental and property management service makes this period easier. For post-delivery subscription and snagging works, you can speak with our after-sales services team.
Frequently asked questions
Can I move into the home before Council of Ministers permission is granted?
If the property has been delivered and your sales contract grants you the right of use from delivery, you can move in. The title deed remains in the seller’s name until permission is granted; your right arises from the contract registered at the Land Registry. Under regulation 89/2026, because electricity and water connections cannot be made before taxes and fees are paid, plan your move-in date according to these payments.
Can I rent out my home while waiting for permission?
You can if your sales contract clearly states the authority to rent it out or if you have obtained written approval from the seller. Sign a written contract with the tenant and regulate in the contract what will happen if permission is refused. In short-term rental, you should also check the site management plan and current notification obligations; also remember that a tenant cannot be placed without active electricity and water subscriptions.
Do I pay tax on rental income while the title deed is not in my name?
Yes. Rental income is the income of the person who earns it, regardless of whose name the property is registered in. According to the 2020 Council of Ministers decision, withholding tax of %13 applies to rent in foreign currency and %8 to rent in TL; the rates should be confirmed as of October 2026. If you are a tax resident in Turkey, ask your financial adviser whether the income must also be declared there.
Can I sell the home to someone else before permission is granted?
Because the title deed is not in your name, you cannot make a sale through the Land Registry; however, you can assign your rights under the sales contract to a new buyer. Assignment is mostly subject to the seller’s written approval. If the new buyer is a foreigner, they must register their own contract at the Land Registry within one month and make their own purchase permission application. The status of your pending application must also be clarified between the lawyers.
Which payments must have been made for electricity connection?
According to decree no. 89/2026, permanent electricity and water connections cannot be made before all taxes and fees have been paid; news summaries state that temporary connections are also included in the scope and that site electricity is an exception. Before delivery, confirm through your lawyer with the Land Registry and Kıb-Tek which items are considered sufficient for connection.
