Deposit When Buying a Home in Cyprus: Refund Terms
Short answer: When buying a home in Cyprus, a deposit is a reservation fee, usually at the level of a few thousand pounds, paid to reserve the unit for a few weeks until the sales contract is signed. The reservation form signed with the deposit is often not a sales contract; it does not give you a right at the land registry, and whether it is refundable depends entirely on the condition in the form. Therefore, before paying the deposit, you should start title deed and permit checks, get the refund condition in writing, and make the payment through a company or lawyer account rather than personal accounts.
This article has been prepared for buyers in Northern Cyprus (TRNC) who receive a deposit request from a sales office or estate agent for an apartment or villa they like, especially those expected to make a decision during a property viewing trip. We explained the entire purchase process in our buying a home in Cyprus step by step guide; here, we focus on the first financial step of the process, namely the deposit.
The difference between a deposit, reservation and down payment
These three concepts are often confused during sales discussions, but their legal consequences are different. The table below summarizes the payment flow commonly seen when buying from a project.
| Stage | What is paid? | With which document? | What does it provide you? |
|---|---|---|---|
| Reservation | Deposit (reservation fee) | Reservation form | A commitment that the unit will not be sold to someone else for a specified period |
| Contract signing | Down payment (the deposit is usually set off against this) | Sales contract | A right arising from the contract to be registered at the land registry |
| Registration of the contract at the land registry | Stamp duty and related fees | Land registry registration document | The basis for the charge on the property and the permit application |
| Construction and delivery | Installments and delivery balance | Payment plan and delivery report | The key and then the title deed transfer process |
The most important point in this table is the difference between the first two stages. The Estate Agents Registration and Transactions Law regulates placing an encumbrance at the district land registry office on the immovable property subject to a sales contract and registering a sales contract made through an estate agent at the land registry within 21 days. A reservation form does not provide this protection. For foreign buyers, the one-month registration period under Decree No. 89/2026 also starts from the signing date of the sales contract, not from the deposit date; details are in our article on registering the contract at the land registry and the one-month rule.
Before paying a deposit when buying a home in Cyprus
Although the deposit may seem like a small amount, it is the moment when the purchase decision is effectively made. Before paying, the following checks should at least have been initiated:
- Title deed search: Obtain the parcel information from the seller; have your lawyer conduct a preliminary check for mortgages, attachments and annotations on the land or unit. We explained the method in our TRNC title deed search article.
- Permit and approved project: When buying from a project, request a copy of the construction permit and the location of the unit you will buy on the approved plan.
- Acquisition limit and quota: For foreign buyers, including Turkish citizens, every signed sales contract is deducted from the acquisition right. Signing reservations and contracts for more than one unit may fill the limit without you realizing it; also ask the sales office about the quota status in the project.
- Loan pre-approval: If you will buy with a loan, obtain pre-approval from the bank before paying the deposit, specifying the title deed (koçan) type; otherwise, you may be left without financing after paying the deposit.
- Estate agent’s registration: If you are working through an estate agent in a resale purchase, see their registration certificate. Under the Law, unregistered persons cannot receive fees in return for estate agency services.
- Information and documents: The Law provides that the property owner must inform the buyer, through their estate agent, of the search certificate obtained from the Land Registry and Cadastre Department and the document showing the zoning status. Do not hesitate to request these documents.
You do not have to pay a deposit on the first day of a property viewing trip. The outcome of a well-planned trip is not a signature, but a clear shortlist of one or two homes; for trip planning, you can see our Cyprus property viewing trip guide.
What a reservation form should include
A reservation form may be a short document, but if the following items are not in writing, you will have no basis to rely on in the event of a dispute:
- Full details of the parties: The title of the seller company or owner, and the buyer’s passport or identity information.
- Description of the unit: Parcel, block and independent section number, floor plan, net and gross area; not only the marketing name.
- Price and payment plan: Total price, currency, down payment and installment schedule, and who is responsible for VAT and other expenses.
- Deposit amount and set-off: It should be clearly stated that the deposit will be deducted from the down payment.
- Reservation period: For how many days the unit is reserved and that the sales contract will be signed within this period.
- Refund conditions: That the full deposit will be refunded in cases such as adverse findings in the title deed search, an inconsistency in the permit or approved project, or the seller changing the price or conditions.
- Payment account: To which account, and in whose name, the deposit will be paid.
Obtaining the technical specifications and floor plan at the reservation stage reduces surprises at the contract signing stage. We covered the clauses that should be included in a contract in detail in our article on what should be included in a contract for buying a home from a project.
Where and how should the deposit be paid?
Who the deposit is paid to is more important than how much is paid. Follow these rules for a secure payment:
- Pay the deposit not into the personal account of the intermediary or sales representative, but into the seller company’s account or a reliable escrow account.
- If possible, keep the deposit in your lawyer’s client account until the title deed search is completed.
- Avoid cash payments and hand delivery; write the unit number and the phrase reservation in the bank transfer description.
- Obtain the seller’s stamped receipt or invoice in return for the payment and keep it together with the reservation form.
- If you are making payment from abroad, take bank charges and exchange rate differences into account; also have the form state in which currency and over which amount the deposit will be refunded.
- Collect all documents in a single folder; the reservation form, transfer receipt and receipt will be the first documents requested at the contract stage and in a possible refund request.
A request for the deposit to be paid into a personal account instead of the company account, or in cash, is a situation experienced buyers see as a warning sign. As in examples such as Salamis Park Villas, one of Akol Global’s completed projects, it is the buyer’s most natural right to request the reservation form, company account details and permit copy in writing from any contractor.
Is the deposit refundable?
The refund of the deposit depends on the condition in the reservation form; it should not be assumed that it will be legally refundable in every case. Common scenarios are as follows:
- If the buyer changes their mind: Unless the form states otherwise, the deposit is often forfeited. Therefore, do not make payment before you are sure of your decision.
- If a title deed or permit issue arises: If the form contains a refund clause for this situation, you can request the full deposit back; if there is no clause, your bargaining power weakens.
- If the seller sells the unit to someone else or changes the conditions: The refund and possible compensation are evaluated according to the undertaking in the form; consult your lawyer.
- If the sale is not completed in a resale: Under the Estate Agents Registration and Transactions Law, if the transaction is not successfully completed, the estate agent is only entitled to be compensated for expenses documented by invoice.
You can access the law text on the Central Legislation Department website.
As the reservation period expires
The few weeks after the deposit are the period when the buyer needs to work most intensively. As the end of the reservation period approaches, you should have these three things in hand: your lawyer’s title deed search result, the reviewed draft of the sales contract, and the payment prepared for the down payment. If one of these is missing, request a written extension from the seller before the period expires; a verbal extension is a commitment that is difficult to prove in the event of a dispute. Check that the price, unit details and payment plan agreed in the reservation form appear unchanged in the draft contract. If the seller wants to change the price or conditions at this stage, the refund clause in the form will be your strongest basis in negotiations. After the contract is signed, the stamp duty and land registry registration periods start to run; putting this timetable into a table with your lawyer from the deposit date prevents deadlines from being missed. We explained the stamp duty deadline and payment steps in our TRNC stamp duty article.
Frequently asked questions
How much deposit is paid when buying a home in Cyprus?
In practice, the deposit is usually at the level of a few thousand pounds and reserves the unit for a few weeks; in purchases from projects, it is common for it to be determined as a small percentage of the sales price and deducted from the down payment. There is no official rate; the amount, period and refund condition should be determined in writing in the reservation form. Confirm the current practice with the seller as of October 2026.
Is a reservation deposit refundable?
This depends entirely on the condition in the reservation form. Have it clearly written in the form that the deposit will be fully refunded in cases such as adverse findings in the title deed search, a permit issue, or the seller changing the conditions. If the buyer only changes their mind, the deposit is often not refunded unless the form states otherwise.
Does a reservation form replace a sales contract?
Often, no. A reservation form ensures that the unit is reserved for a certain period, but it does not provide the protection of a sales contract registered at the land registry; the encumbrance placed on the property subject to a sales contract is also not created by a reservation. For foreign buyers, the one-month registration period also starts from the signing date of the sales contract, not from the deposit date.
Who should I pay the deposit to?
Pay it to the seller company’s own account or a reliable escrow account; if possible, to your lawyer’s client account until the title deed search is completed. Do not make payment to the personal account of the intermediary or sales representative, and avoid giving cash. Write the unit number in the transfer description and obtain a stamped receipt.
Does paying a deposit affect my acquisition right?
The main transaction deducted from the acquisition right is the sales contract; however, making reservations for more than one unit and proceeding to contract may cause foreign buyers, including Turkish citizens, to fill their acquisition limit without realizing it. If you are planning more than one purchase within the family, plan whose name each purchase will be made in with your lawyer before the deposit stage.
