Cyprus Rental Agreement: Clause Guide

Short answer: A Cyprus rental agreement is made in writing, signed by both parties in the presence of two witnesses, stamped and registered with the Revenue and Tax Office within 21 days after signing. An unregistered agreement is of no use in a dispute. The rent amount, currency, deposit, term, termination, maintenance fees and who is responsible for bills must be clearly stated.

This article has been prepared for landlords renting out their apartment for the first time in Northern Cyprus (TRNC) and investors managing property remotely from Turkey. We explain, with examples, which clauses should be included in the agreement, how the deposit should be structured, the registration steps, and where local rental legislation limits the landlord.

Why should a Cyprus rental agreement be written and registered?

A registered rental agreement both puts your tax obligations in order and is the only solid document you have in case of a dispute with the tenant. A verbal agreement or WhatsApp correspondence does not carry the same weight in court or before the tax office.

According to the property letting guide by Erginel Law, which operates in the TRNC, an agreement not registered with the tax office does not create legal status for the parties; in a dispute, it is not possible to apply to the court or another institution. The same source states that the tax office monitors rental listings and, in unregistered rentals, can estimate income by looking at similar listings.

A significant portion of problematic files received by the Akol Global rental and property management team arise from apartments rented out without an agreement or without registration because the tenant was an “acquaintance”. When the tenant stops paying, the landlord has neither a rental record nor a deposit condition in hand.

Clauses that must be included in the agreement

A good Cyprus rental agreement defines the parties, property, rent, term, deposit, allocation of expenses and termination conditions without leaving room for doubt. Preparing the Cyprus rental agreement bilingually in Turkish and English reduces later objections from foreign tenants such as “I did not understand”.

ClauseWhat should be written? What happens if it is omitted?
PartiesName-surname, ID/passport no., address, phone, emailProblems arise during notification and registration
Property descriptionComplex, block, apartment no., title deed (koçan) or sales agreement informationWhich unit is being rented becomes disputed
Rent amount and currencyAmount, £ or TL, payment date, bank accountExchange rate and delay disputes; tax rate becomes unclear
TermStart-end date, extension conditionThe tenant may be considered “indefinite”
DepositAmount, refund period, cases where deductions may be madeThe most common source of disputes at move-out
ExpensesWho is responsible for maintenance fees, electricity, water, internet, municipal taxMaintenance fee debt remains with the landlord
Inventory listFurniture, white goods, air conditioning; photo appendixIt becomes difficult to prove damage
Subletting and useSubletting ban, pets, smokingThe apartment may be rented to someone else short term
Termination and noticeEarly move-out notice (e.g. 1–2 months), written noticeThe tenant leaves without notice, and the vacant month is on you
Maintenance-repairMinor faults with the tenant, structural faults with the landlordAir conditioner service and plumbing bills are disputed

The maintenance fee clause requires separate attention. In long-term rentals, transferring the maintenance fee to the tenant is common and significantly increases net return; you can see this effect in the sample table in our Cyprus rental yield calculation article.

How much should the deposit be and how is it refunded?

In the TRNC market, the deposit for long-term residential rentals is generally 1 month’s rent, and around 2 months’ rent for furnished and high-value apartments. We could not identify any current regulation on a legal upper limit for the deposit; confirm with your lawyer as of October 2026.

Do not count the deposit as the “last month’s rent”. If the tenant does not pay the last month and offsets it against the deposit, you will have no security left for damage identified at move-out. Write the following in the agreement: the deposit cannot be used instead of rent, and after the move-out inspection, it is refunded within a specified period (e.g. 30 days) with deductions justified.

Example: A £1.200 deposit was taken for a furnished 1+1 rented at £600 per month. At move-out, a burn on the sofa fabric (£180) and an unpaid final-month electricity bill (£45) were identified. Because there was a photo move-in report, the £225 deduction was documented and £975 was refunded to the tenant. Without a move-in report, the same deduction would most likely have become a matter of dispute.

Stamp duty and tax office registration steps

The rental agreement is stamped and registered with the district Revenue and Tax Office within 21 days after signing; in practice, the stamp cost belongs to the tenant. For the stamp rate and amount, obtain up-to-date information from the tax office as of October 2026; we could not find an official source where we could verify the exact rate.

  1. Prepare the agreement. The bilingual text, inventory list and photo move-in report should be attached as appendices.
  2. Sign it. The landlord, tenant and two witnesses sign. If you are not on the island, the signature is made by an authorized person with a power of attorney.
  3. Collect the documents. The tenant’s passport (original and copy), the landlord’s passport copy, a copy of the title deed (koçan) or stamped sales agreement.
  4. Have it stamped and registered. Apply to the tax office within 21 days; late registration may lead to a penalty.
  5. Choose the tax payment plan. Rental income tax is paid each month by the 15th of the following month or can be paid in advance for the entire period at registration.
  6. Notify the end. When the tenant leaves, notify the tax office; otherwise, assessment may continue.

The details of tax rates, declaration procedure and declaration in Turkey are the subject of our TRNC rental income tax article; here we only summarize the part concerning the agreement.

Rent Control Law and statutory tenancy

In the TRNC, the Rent Control Law No. 17/1981 strongly protects tenants in places declared as a “controlled area” by the Council of Ministers: even if the agreement term ends, the tenant is considered a “statutory tenant” and can only be evicted for the reasons listed in the law. This means that not every clause written by the landlord in the agreement can be enforced.

As stated in the information note published by METU Northern Cyprus Campus, the law considers failure to pay the rent within one week from the final payment date as grounds for eviction. Even if the agreement says “termination if delayed by 3 days”, this one-week period cannot be shortened. Other grounds for eviction include breach of agreement, disturbing neighbours, serious damage to the property, unauthorized subletting, and the reasonable need of the landlord, their spouse or their child who has reached the age of 18.

For properties outside controlled areas, the tenant does not gain statutory tenancy status when the agreement ends. Knowing the status of your property determines how you should write the termination and term clauses in the agreement. Confirm the current scope of application of the law and possible changes with a TRNC lawyer as of October 2026; the route to follow if the tenant does not pay is also discussed in our finding a tenant in Cyprus and rental problems article.

Sterling or TL: currency and increase clause

The rent currency determines both the tax and the increase negotiation: tax is %13 on foreign-currency rent and %8 on TL rent, and without an annual increase clause in TL rent, income quickly erodes. In the TRNC, residential rents are mostly discussed in Sterling, but this is a serious burden for local tenants earning TL salaries.

Sample calculation (assuming 1 £ ≈ 64 TL, October 2026; confirm the exchange rate):

ScenarioMonthly rentTax rateMonthly taxAfter tax
Sterling rent£600%13£78£522
TL rent38.400 TL (≈ £600)%83.072 TL (≈ £48)35.328 TL (≈ £552)

At first glance, TL rent leaves approximately £30 more per month. However, if TL loses value against Sterling during the year, the difference reverses in a short time. If you rent in TL, write a clear increase formula into the agreement: for example, “every 6 months at the CPI rate announced by the TRNC Statistical Institute” or a fixed percentage accepted by the parties. For the index, data from the TRNC Statistical Institute can be used as a reference.

The most common agreement mistakes made by landlords

The most costly mistakes are an unregistered agreement, an unclear maintenance fee clause and not preparing an inventory list at all. The list below is for checking your own text before signing:

  • Using a Turkey template downloaded from the internet. Texts written according to the Turkish Code of Obligations do not align with TRNC legislation.
  • Showing the rent amount lower in the agreement. This practice, used to reduce tax, means that in a dispute you can only claim the written amount and increases the tax risk.
  • Making the agreement with an intermediary instead of the tenant. If the person living in the apartment is not in the agreement, finding the party in an eviction becomes difficult.
  • Leaving the electricity and water subscriptions in your own name. If they cannot be transferred to the tenant’s name, at least write the final meter readings in the report.
  • Leaving a loophole that allows short-term rental. If a subletting ban is not written, the apartment may be rented daily; this creates problems in terms of complex rules and insurance.

Landlords who do not want to handle agreement and registration matters remotely can transfer this process to a management company; we explained what to pay attention to in our choosing a property management company in Cyprus article. Akol Global’s rental and property management service also covers tenant selection, agreement and registration steps.

Frequently asked questions

Within how many days must a rental agreement be registered in the TRNC?

The rental agreement must be registered with the Revenue and Tax Office and stamped within 21 days after signing. Late registration may lead to a penalty; an unregistered agreement does not constitute a legal basis in a dispute. For registration, the signed agreement, signatures of two witnesses, passport copies of the parties and a copy of the title deed (koçan) or stamped sales agreement are requested. Confirm the procedure with the tax office as of October 2026.

Who pays the stamp duty on the rental agreement?

In practice, the stamp cost of the rental agreement belongs to the tenant and this should be clearly written in the agreement. The tax paid by the landlord is a separate item: %13 of the gross rent for foreign-currency rent and %8 for TL rent is paid as rental income tax. Learn how the stamp amount is calculated from the tax office during registration; the rate may change over time.

How many months’ rent should the deposit be?

In the TRNC, a deposit of 1 month’s rent is common in long-term rentals; it can increase to 2 months in furnished, high-value or short-term agreements. Write into the agreement that the deposit cannot be used instead of rent, within how many days after the move-out inspection it will be refunded, and in which cases deductions will be made. It is difficult to make deductions without a photo move-in report.

Can I remove the tenant when the agreement term ends?

If the property is in a controlled area where the Rent Control Law No. 17/1981 applies, even if the term ends, the tenant is considered a statutory tenant and can only be evicted for the reasons in the law. If it is outside a controlled area, the situation is different. Do not make a termination plan without checking the status of your property and the current practice with a TRNC lawyer.

Should the rental agreement be made in Sterling or TL?

Sterling rent transfers exchange rate risk to the tenant but is subject to %13 tax; TL rent appears to leave more at first glance with %8 tax, but it is exposed to exchange rate loss. If you prefer TL, add an index-linked or fixed-percentage increase formula to the agreement. The currency in which your target tenant earns income also affects the decision.
