Selling a Home in the TRNC: Process and Documents

Short answer: The Northern Cyprus (TRNC) home sales process consists of clarifying the title deed and debt status, working with a registered estate agent, registering the sales contract signed with the buyer at the Land Registry, and completing the title deed transfer. The Law on the Registration and Transactions of Estate Agents requires real estate sales to be carried out through a registered estate agent, except for exemptions such as intra-family transfers. If the buyer is a foreigner, the process can take months because the transfer can only be made after their Council of Ministers permit is published.

This article has been prepared for homeowners who are considering selling a residential property in the TRNC whose title deed (koçan) is registered in their own name; we also wrote it with those who live in Turkey and want to manage the sale remotely in mind. In our article on tax when selling a home in the TRNC, we explain the withholding tax paid on the sale and the net amount you will receive with a sample calculation; here, we focus on the sequence of the process and the documents.

Before the sale: title deed status and documents

The first question when selling a home in the TRNC is what you are selling. If the title deed (koçan) is registered in your name, the transaction to be carried out is a title deed transfer. If you are selling a property you purchased from a project and the title deed has not yet been transferred into your name, the transaction is an assignment of contract; different rules apply, such as developer approval and transfer fees. We covered this second situation separately in our article on selling a property bought from a project before delivery.

For a property with a title deed, preparing the following documents before listing it for sale can save weeks once a buyer is found.

The Law on the Registration and Transactions of Estate Agents stipulates that the property owner must notify the buyer, through their estate agent, of the search certificate to be obtained from the Land Registry and Cadastre Department regarding the physical condition of the immovable property and its encumbrances, and the zoning status document to be obtained from the Department of Town Planning. Preparing these documents from the outset both fulfils the legal obligation and increases the buyer's confidence. Check in advance whether there is any unexpected annotation in your record using the method in our TRNC title deed search article.

Registered estate agent requirement and commission

The most important rule that someone who wants to sell a home in the TRNC should know, unlike in Turkey, is this: According to Article 14 of the Law on the Registration and Transactions of Estate Agents, except for the exemptions in Article 20 of the Law, the procedures for an immovable property transaction must be carried out by an estate agent. The Law also provides that, in a sale carried out through an estate agent, the title deed transfer cannot be made unless the estate agent's name, address, registration number and commission amount are stated in the transfer declaration.

  • Exceptions: An estate agent is not required for transactions between parents, children, grandchildren, first-degree in-laws, spouses and siblings. A non-professional person may also carry out a sale without an estate agent, if the buyer requests it, by obtaining the Ministry's favourable opinion.
  • Commission: The Law regulates the estate agent's right to receive a commission at a rate of not less than 3 percent and not more than 5 percent of the sale price; unless there is another agreement, the commission is requested when the transaction is completed. The rate and VAT status should be written in the agency agreement.
  • If the sale does not take place: If the transaction is not successfully completed, the estate agent has the right to be compensated for expenses documented by invoice.
  • Registration check: Persons who are not registered or who have been removed from the register cannot receive a fee in return for estate agency services. Ask to see the registration certificate of the person you will work with.

For who pays the commission and market practice, you can review our article on TRNC estate agent and lawyer fees. As of October 2026, you can read the current text of the Law on the Central Legislation Department website and confirm the practice with your lawyer.

TRNC home sales process step by step

After the preparation is complete, the sale of a residential property with a title deed usually proceeds in the following order. Whether the buyer is a TRNC citizen or a foreigner determines the duration of the fifth and sixth steps in particular.

  1. Value and price: Set a price according to comparable sales in the area; calculate your exit cost and see the net amount you will receive.
  2. Agency agreement: Clarify the commission rate, term and exclusivity clauses with the estate agent in writing.
  3. Preliminary agreement with the buyer: The price, payment plan, transfer date and condition of furnishings are discussed; if a deposit is to be taken, the refund condition is written down.
  4. Sales contract: The contract is reviewed and signed by the lawyers of both parties. Stamp duty is paid.
  5. Registration of the contract at the Land Registry: The sales contract carried out through an estate agent is registered with the district land registry office within 21 days as required by the Law, and a prohibition is placed on the property. For foreign buyers, the one-month registration rule in Decree No. 89/2026 also applies.
  6. Buyer's permit: If the buyer is a foreigner, the Council of Ministers permit is awaited; after the permit is published, the periods for fees and transfer begin to run.
  7. Final checks: Immediately before the transfer, the record is checked again; municipality, maintenance fee and utility bill debts are settled.
  8. Title deed transfer: The parties or their attorneys sign the transfer declaration at the district land registry office; the seller's withholding tax and the buyer's fee are paid, and the title deed (koçan) is issued in the buyer's name.

According to the Land Registry and Cadastre Department's July 2025 announcement, during the transition to the new system, transfer transactions such as sale, donation and exchange, as well as the search certificate, are being carried out only at the district land registry office to which the immovable property is attached. Check whether this temporary practice is still in effect before the transaction.

What does the prohibition do?

The prohibition placed on the property through the registered sales contract protects the buyer: the seller cannot sell the same property to someone else or have it mortgaged without the buyer's written consent. According to the Law, a written declaration by the parties to the contract is required for the prohibition to be removed; when the property is transferred into the name of the buyer in the contract, the prohibition is automatically lifted. If the contract is terminated, the prohibition is lifted upon submission of the termination decision to the land registry office. As a seller, the practical meaning of this is that withdrawing from a registered contract is not as easy as withdrawing from a verbal agreement.

If the buyer is a foreigner: timing and payment plan

For foreign buyers, including citizens of Turkey, the title deed transfer is made after the buyer's Council of Ministers permit is published in the Official Gazette; after the permit, there is a period of 75 business days for the fee and 1 year for the transfer. We explained how the permit process works in our Council of Ministers permit guide.

This waiting period directly affects the seller's payment plan. A commonly seen structure in practice is that a significant portion of the price is paid upon signing the contract, and the balance is paid on the transfer day. Making payments through the lawyer's client account or via bank channels instead of personal accounts protects both parties and makes it easier for you to provide documentation when transferring the sale proceeds abroad in the future. Have the contract clearly state how payments will be refunded if the permit is refused and who will use the home during this period.

If you are selling a tenanted property

If there is a tenant in the home, show the buyer the tenancy agreement, who holds the deposit and the expiry date of the tenancy agreement in advance. Also remember that whether the immovable property is rented is declared in the transfer declaration. We covered the subject separately in our article on selling a tenanted property.

Remote sale and what to do after the transfer

You do not have to be present in the TRNC for the sale; the procedures can be carried out through your lawyer with a power of attorney whose scope is clearly written. The power of attorney should include the property's parcel and independent unit information, and the powers to sign the sales contract, collect the price, sign the transfer declaration and pay taxes. The safest way is to obtain the text from your lawyer in the TRNC and have it prepared exactly at the notary.

After the transfer is completed, close the following matters:

  • Close the electricity and water subscriptions or transfer them to the buyer; document the final meter reading and request the deposit refund.
  • Notify the municipality and site management of the change of owner.
  • Cancel your home insurance or speak with your insurer about transferring it to the buyer.
  • Keep the withholding tax receipt, transfer documents and bank receipts.
  • If you are a tax resident in Turkey, ask your financial advisor whether the sale gain is subject to declaration there.

Frequently asked questions

Can I sell my home in the TRNC without an estate agent?

As a general rule, no. The Law on the Registration and Transactions of Estate Agents requires the procedures in immovable property sales to be carried out by a registered estate agent, except for exemptions. Transactions between parents, children, grandchildren, spouses, siblings and first-degree in-laws are exempt. Non-professional sellers may sell without an estate agent with the Ministry's favourable opinion if the buyer requests it; confirm the practice with your lawyer.

What percentage is the estate agent commission in the TRNC?

The Law on the Registration and Transactions of Estate Agents provides that the commission must not be less than 3 percent and must not exceed 5 percent of the sale price. Unless there is another agreement, the commission is paid when the sale is completed. The rate, whether VAT is included and the exclusivity conditions should be clearly written in the agency agreement signed with the estate agent. If the sale does not take place, the estate agent may only request invoiced expenses.

Does the sales contract have to be registered at the Land Registry?

Yes. The sales contract carried out through an estate agent is registered with the district land registry office within 21 days by paying the required fees as required by the Law, and a prohibition is placed on the property. If the buyer is a foreigner, the one-month registration rule in Decree No. 89/2026 also applies. Registration protects the buyer's right and is the basis for the permit application.

How long does the sale take if the buyer is a foreigner?

The contract and registration can be completed within a few weeks, but the transfer waits for the buyer's Council of Ministers permit to be published. After the permit is published, there is a period of 75 business days for the fee and 1 year for the transfer. Therefore, the payment plan, refund conditions in the event that the permit is refused, and the transfer date must be clearly written in the contract.

Can I sell my home while I am in Turkey?

Yes. The sale can be carried out through your lawyer with a power of attorney whose scope is clearly written. The power of attorney should include the property's parcel and independent unit information and the powers to sign the sales contract, collect the price, sign the transfer declaration and pay taxes. Obtaining the text in advance from your lawyer in the TRNC reduces the risk of the document being rejected.
